By accepting delivery or making payments, customers agree to these Rental and Service Terms, whether or not a Rental and Service Agreement has been signed. Terms and the Rental Protection Plan (if applicable) are available online at Rentals Terms & Condition.

1. Definitions

  • Agreement: Rental and Service Agreement, Reservation Details, and related documents.
  • Philision: Philision Rentals.
  • Scissor Lift: The aerial lift specified in the Reservation Details, including attachments and accessories.
  • Customer: The entity or individual renting the equipment, including representatives and employees.
  • Store Location: Philision’s designated rental facility.
  • Qualified Operator: An authorized individual with the required license and training (if applicable).
  • Rental Period: The time from “Rental Out” to “Scheduled In” unless ended earlier.
  • Credit Card: The payment method provided by the Customer.
  • Reservation Details: Equipment specifications, rental duration, and payment terms.
  • Services: Delivery, pickup, and maintenance of the Scissor Lift.

2. Authority to Sign

By signing, the individual confirms they are of legal age and authorized to act on behalf of the Customer.

3. Indemnity / Hold Harmless

The Customer agrees to indemnify and hold harmless Philision, its officers, employees, and affiliates from claims, damages, or liabilities arising from the use, transportation, or rental of the Scissor Lift. Upon delivery, both parties will inspect the equipment and sign an equipment waiver liability form. After signing, the Customer assumes full responsibility, and Philision is not liable for future claims or damages. This obligation continues after the Agreement ends.

4. Equipment Inspection

The Customer must inspect the Scissor Lift before use and report any issues immediately. They are responsible for ensuring all safety features are functional.

5. Limitation of Liability

Philision is not liable for damages, lost profits, delays, or penalties resulting from equipment use, delivery issues, or malfunctions. The Customer assumes all risks associated with the equipment.

6. Customer Responsibilities

The Customer must provide accurate rental information, ensure only Qualified Operators use the equipment, comply with safety regulations, and maintain a safe work environment. Non-compliance may result in service refusal at the Customer’s expense.

7. Equipment Use

  • Use & Safety: Only Qualified Operators may use the Scissor Lift. Daily inspections are required. Philision may replace but not inspect equipment during rental.
  • Compliance & Maintenance: The Customer must follow all laws and return the lift in good condition (normal wear excepted). Repairs due to misuse are the Customer’s responsibility.
  • Malfunction & Repairs: Philision will repair or replace malfunctioning equipment if caused by normal use. The Customer bears costs for misuse-related damages.
  • Return of Equipment: The Customer must return the lift or arrange pickup at the rental period’s end. Fees apply until return in acceptable condition. Lost or destroyed equipment must be paid for in full.
  • Indemnification: The Customer indemnifies Philision from claims due to improper equipment use, maintenance, or operation.

8. Rental Period & Charges

The rental starts when the Scissor Lift leaves Philision’s location and ends when returned or picked up, following an “off rent” confirmation. Additional charges apply for delivery, pickup, extra usage, and late returns.

9. Refueling & Environmental Fees

A refueling charge applies if the lift is not returned full. A 3% environmental service fee (max $95) covers compliance with regulations.

10. Deposit & Payment

A deposit is due 24 hours before rental. Late payments incur a 2% monthly fee. Taxes and surcharges apply.

11. Title & Responsibility

Philision retains ownership of the equipment. The Customer may not sublease or modify it and is responsible for tire repairs.

12. Default & Insurance

Non-payment or non-compliance may result in equipment repossession. The Customer must maintain liability and property insurance for damages or loss.

13. Scissor Lift Rental Services

Philision provides rentals, delivery, and pickup. Customers must operate the equipment per manufacturer guidelines, OSHA standards, and safety regulations.

14. Additional Terms & Charges

  • Accidents, Theft & Vandalism: Report immediately to Philision and local authorities.
  • Third-Party Charges: Customers are responsible for taxes, licensing, and surcharges.
  • Cleaning Fees: At least $200 applies for excessive cleaning.
  • Non-Smoking Policy: Smoking or vaping is prohibited; a $200 odor removal fee applies.
  • Recovery Costs: The Customer covers costs if the lift requires recovery due to misuse.
  • Lost Keys & Lockouts: A $50 administrative fee applies.
  • Fines & Violations: The Customer is liable for fines and penalties, with a $25 processing fee.
  • Tolls & Fees: Customers must pay tolls; a $5 service fee applies if billed to Philision.
  • Mileage Charges: Limits and additional fees apply per the rental agreement.
  • Tracking & Return Compliance: Some lifts have tracking. Late returns may result in legal action.
  • Remote Drop-Off Fee: Additional charges apply for returning to a different location.
  • Customer-Installed Devices: Written consent is required for any modifications.

15. Entire Agreement

This Agreement constitutes the entire understanding between Philision and the Customer. No oral agreements apply. Amendments must be in writing and signed by both parties.

16. Order of Precedence

This Agreement overrides any conflicting terms in the Customer’s purchase order unless expressly acknowledged in writing.

17. Jury Waiver & Legal Matters

Legal disputes will be handled in the courts of the Store Location. Both parties waive their right to a jury trial.

18. Force Majeure

Neither party is liable for failure to perform due to uncontrollable events such as natural disasters, war, or pandemics.

19. Changes to Terms

Philision may update these terms at any time. Continued rental use constitutes acceptance of changes.

  • Eligibility: Available only to direct commercial customers.
  • Cost: 15% of the rental charges for covered equipment.
  • Coverage: Philision waives certain accidental damage or theft claims if the lift is properly operated and used per safety guidelines.
  • Exclusions: The plan does not cover misuse, negligence, improper operation, maintenance failure, intentional damage, third-party property damage, or injuries.
  • Not Insurance: This plan is not insurance but limits liability for accidental damage or theft. Other risks, including injuries and environmental hazards, are not covered.
  • Customer Responsibility: The Customer must still maintain and operate the equipment per the Rental and Service Terms.
